1. Who publishes the game

8 Américain : Duel is a game designed and published by SUNDER DEV, the trade name of Ahmed Sanoko, a sole trader registered in the French national business register (SIREN 980 468 870, SIRET 980 468 870 00020, APE code 6201Z), 69 rue de Mon Désert, 54000 Nancy, France. Contact: contact@sunderdev.com.

2. The game

8 Américain : Duel is a free card game distributed on the App Store and Google Play. By installing the game, you accept these terms as well as Apple’s or Google’s terms for downloads and purchases. Games against bots work offline; online games, games with friends and purchases need an internet connection. Coins staked online have no real value: this is not a gambling game.

3. Username

Your username is visible to other players online: it must not be offensive, discriminatory, sexual or impersonate anyone, and must not contain personal information.

4. Online games

Online games go through Unity’s servers. Play fair: any attempt to cheat, modify the game or disrupt other players’ games may lead to your access to online features being blocked. Leaving a game loses your stake. These services may be interrupted for maintenance or in case of outage; an interrupted game refunds the stakes.

5. In-app purchases

The game offers a “No ads” purchase, coin and gem packs and a special finisher, at the price shown in the App Store or Google Play at the time of purchase. Payment is processed by Apple or Google; SUNDER DEV never receives your payment information.

This is digital content supplied immediately: by confirming the purchase, you request its immediate supply and acknowledge that you lose your right of withdrawal (article L. 221-28, 13° of the French Consumer Code). For a refund, contact Apple or Google, who apply their own rules. A minor needs their parents’ consent to make purchases; Apple’s and Google’s parental controls can block purchases.

6. Coins, gems and in-game items

Coins, gems, finishers, card backs and table cloths only have value in the game. They cannot be exchanged for money, transferred to another player or refunded. They are saved on your phone and disappear if you uninstall the game or clear its data; “Restore purchases” brings back the “No ads” purchase made with your Apple or Google account.

7. Promo codes

A promo code is personal and cannot be sold or traded. SUNDER DEV may deactivate a code at any time; whatever it has already unlocked is kept.

8. Changes to the game

SUNDER DEV may change the game: rules, modes, balance, in-game prices and items. Some settings can be adjusted remotely, without an update. These terms may change; the update date is shown at the top of this page.

9. Intellectual property

The game, its graphics, sounds, texts and code belong to SUNDER DEV or its licensors. You receive a personal, non-exclusive and non-transferable right to play 8 Américain : Duel, without copying, modifying or reselling it.

10. Liability

SUNDER DEV provides the game with care but cannot guarantee that it runs without interruption or error on every device. Nothing in these terms limits your statutory consumer rights, including the legal guarantee of conformity for digital content.

11. Personal data

The data processed by the game is described in the privacy policy.

12. Applicable law and disputes

These terms are governed by French law. If there is a problem, first write to contact@sunderdev.com: we will look for an amicable solution. A consumer can also use a consumer mediator free of charge.
